2009 Tube My Ride Competition
Conditions of Entry
The 2009 Coca-Cola Tube My Ride Competition ("TMR") is jointly promoted by Perisher Blue Pty Limited ACN 061 232 488 ATF Snow Trust ABN 29 420 214 757 and Coca-Cola Amatil Australia Pty Limited ABN 68 076 594 119 (jointly the "Promoter").
The Event
The 2009 TMR will be held over the weekend of 1-2 August 2009. It is a new and exciting competition concept that allows an individual or a group of individuals ("Entrant") to show their skills and creativity on the slopes and in the video editing room with the result voted on by their peers. There is a $5,000.00 prize for the winning entry.
The location for the 2009 TMR is the PlayStation Slopestyle course ("Venue") adjacent to the Village Eight Express Chairlift on Perisher’s Front Valley.
Conditions of Entry
- TMR is not an opportunity for Entrants to promote reckless stunts that cause or have the potential to cause injury to the Entrant or the risk of injury, embarrassment, defamation or inconvenience to other resort guests or the Promoter’s employees or in any way denigrate the Promoter for the sake of perceived humour or for any other purpose. Any entry received, which breaches these strict guidelines, will be excluded immediately.
- Entry is only open to Australian residents. Employees (and their immediate families) of the Promoter, or agencies or companies associated with the TMR, are ineligible to enter.
- The Promoter reserves the right to exclude any entry, which they deem to be inappropriate for any reason and will not be bound to provide a reason for the exclusion.
- The Venue will not be available for participant’s exclusive use. Entrants must consider the safety of others when filming their Entry. Entrants can film at other times as long as all other points in these Conditions of Entry are adhered to.
- All Entrants must be 15 years or over.
- All Entrants must complete a Perisher Event Participation Waiver online at www.perisher.com.au prior to 1 August 2009. Completed Event Participation Waivers must be faxed to: (02) 6457 5647 or hand delivered to Perisher Guest Services before filming for TMR commences.
- All Entrants must abide by the Alpine Responsibility Code which is available online at www.perisher.com.au.
- Only one video file (“Entry”) will be accepted per Entrant.
- The Entry submitted shall not be longer than 3 minutes in duration.
- The Entry must contain images (at least once) of both the Coca-Cola and Perisher signage at the Venue.
- The Entry must be posted on YouTube and linked to the Perisher website: www.perisher.com.au (“Website”) (follow the link to TMR).
- By providing a link to the Website the Entrant warrants they have read and accepted the Terms and Conditions for the use of the Website www.perisher.com.au/winter/info/website_tandc.html
- Entries must be received by 5:00pm 15 August 2009. Entries are deemed to be received at the time of receipt by the Promoter. Records of the Promoter are final and conclusive as to time of receipt.
- Entries will be judged on-line using a peer voting system via the Perisher website. One vote per person per entry will be accepted.
- The Promoter will determine the quality and other attributes of the entry before any entry will be posted for voting. The Promoter reserves the right to withhold nomination of a winning entry and the subsequent payment of prize money for any reason. The Promoter’s decision will be final.
- All Entrants warrant that their Entry is original material specifically recorded, produced and submitted by them for the TMR and that the Entrant is not in breach of any copyright, intellectual property rights or any other restriction with respect of the use of any audio, visual or any other component of their Entry by the Promoter.
- Entrants are permitted to and must use music from the top 12 prize-winning songs of the 2009 PlayStation Perisher Launch Your Band Competition (Song) as part of their Entry. These Songs are available on the Perisher Website and must not be altered or modified in any way other than time editing to fit the Entry.
- Each Entry must contain a credit identifying the name of the Song and artist.
- All Entrants warrant that any use of the content of their Entry or any part thereof by the Promoter for a period of 18 months after the close of the TMR does not entitle them to any fee, rights or any other form of consideration other than the prize money paid to the winning Entry and acknowledgement by the Promoter in the form of video credits should the Entry be displayed for any purpose by the Promoter.
- All Entrants warrant that upon submission of their Entry that they relinquish ownership of the content of the Entry to the Promoter and that they must have written permission from the Promoter prior to any public use of the content by the Entrant for a period of 18 months after the close of the TMR.
- Total prize money for the winning entry is $5,000.00.
General
- Information on how to enter and prizes form part of these Terms and Conditions.
- The Promoter and its associated agencies or companies accept no responsibility for lost, late, stolen, damaged or misdirected entries.
- If for any reason the TMR is not capable of running as planned, the Promoter reserves the right in its discretion to modify the terms of the TMR including the prizes and these Conditions of Entry.
- Any tax liability arising as a result of accepting any prize is the responsibility of the Entrant.
- The Promoter has no control over internet or mobile telephone communications, networks, servers, computer equipment, software, on-line systems, phone lines and/or viruses and accepts no responsibility for any problems associated with them, for whatever reason.
- The Promoter and its agents will not be liable for any injury, loss or damage of any nature whatsoever (including but not limited to indirect or consequential loss) which is suffered or sustained as a result of or in connection with receiving, taking or using any prize except for any liability which cannot be excluded by law.
- The Promoter requires the Entrant’s personal information in order to conduct the TMR. If the Entrant does not provide the mandatory personal information requested then the Entrant will not be able to take part in the TMR. By entering this TMR, the Entrant is taken to consent to the Promoter using the Entrant’s personal information to administer the TMR, and disclosing the Entrant’s personal information to organisations that assist the Promoter with administering the TMR and to third parties as required by law (including authorities that regulate this TMR). The Promoter is bound by the National Privacy Principles in the Privacy Act 1988 (Cth) and by entering the TMR, the Entrant is taken to consent to the Promoter’s privacy policy (which is available on request). By entering into the TMR, each Entrant also consents to the Promoter using their personal information for future marketing purposes. An Entrant may access and correct any personal information held by the Promoter, upon request to the Promoter.
- These Conditions of Entry are governed by the laws of the state of New South Wales.
